In this class action, plaintiff Marianna Gergel alleged that Best Buy and AOL engaged in unfair, misleading, and/or deceptive practices by improperly enrolling consumers in AOL's internet service plans without obtaining prior consent or authorization and that AOL posted charges for theses services to consumers' credit cards, debit cards, or bank accounts. Defendants agreed to a settlement to pay class members not more than $5 million dollars. Defendants agreed to pay an additional sum to cover costs and attorney fees not to exceed $1.7 million.
